New Paths For Labor Law In Brazil

Recent changes in the legal framework have made Brazilian labor market less expensive for employers.

As the global economic evolves into a much more dynamic market, heavily dependent upon systems, machines and software, it is necessary to reassess the labor relations. Flexibilization of labor rules seems to be a world necessity, as the troubled French reform that took place not too far ago serves as an example. Brazil is following the same steps. The so-called labor reform has been discussed and debated among governmental authorities, businessmen, workers’ unions and legislators for years.

Recently, in the mist of the economic crisis that is haunting the country and with the government promises that the labor reform was a necessary step to reduce impressive unemployment rate (with impressive more than 14 million unemployed) and preserve current positions, Congress enacted federal statute nº 13.467/2017 with new and more flexible rules to regulate the relations between employees and employers.

The above-mentioned statute promoted a deep change on such relations adapting the more than 70 years old legal framework, that mostly contained restrict provisions that reflected a different scenario. This almost centennial piece of legislation many times discouraged foreign investment as it created heavy burdens for employers in Brazil. Labor reform was target to adapt Brazilian legislation to the current reality of the market and promote the modernization of labor relations with much more security.

As an example we may mention (i) the creation of intermittent labor contract, for non-regular works, (ii) flexibilization of labor obligations for employees that receives a wage more than a certain limit set forth in the statute and may, therefore, waive some rights and benefits granted by law, (iii) home office was introduced in the legislation and dully regulated, (iv) possibility of negotiations between unions and companies to supersede what stated in the statute etc.

The new legislation also brought some procedural innovations designed to establish a new balance in the labor procedure, such as the burden of losing a case. As happens in civil litigation, the losing party will now have to pay attorney fees for the other party lawyers, limited to a percentage of the claim. This innovation is designed to prevent frivolous litigation.

Therefore, although the reform has ruffled the feathers on the labor law community in Brazil it seems a path that need to be followed with enthusiasm. Surely a new scenario and a new legal framework that will hopefully help the country.
